On December 5th,2012,  Montgomery responded to the victim’s residence in reference to a home visit on a case he was assigned involving her son. While at the residence, the victim’s children arrived home from school and Montgomery asked them to leave the residence. Montgomery is then alleged to have told the victim that she “needed” to have sex with him. The victim said no at which time Montgomery said, “Well then I am going to be forced to do what I have to do”. The victim said she felt helpless due to his position with DCF so she did not resist and was sexually battered.

Several weeks later, the victim reportedly got a phone call from Montgomery urging her to immediately return home so he could speak with her in reference to additional information he received from the police. The victim met Montgomery at her residence at which time Montgomery said, “You owe me for getting you out of trouble”. At this point and time, Montgomery sexually battered the victim again.

On September 11, Violent Crimes Detectives interviewed spoke with Montgomery and he denied having any sexual or personal interaction with the victim at any time.

On December 9, detectives received notification from the Florida Department of Law Enforcement that DNA evidence found in the victim’s residence matched the DNA profile of Montgomery.

On December 12, 2013, Lakeland Police Department Violent Crimes Detectives obtained an arrest warrant for Montgomery. He was arrested by the Bartow Police Department without incident on the behalf of the Lakeland Police Department as he returned to work. Montgomery has been booked into Polk County Jail and charged with:
