UPDATE [9/15/2017 | 1:04 PM] We have been notified that the County and Sheriff's office have rescinded the established curfew beginning this evening at midnight. The City of Lakeland will follow suit and concentrate our patrol efforts in those areas that are still without electric service. 


Polk County Implements Order for Curfew

POLK COUNTY EMERGENCY DECLARATION ORDER 17-03 

AN ORDER AND DECLARATION IMPLEMENTING A CURFEW DURING THE DECLARED STATE OF EMERGENCY 17-01FOR HURRICANE IRMA

WHEREAS, the Governor of the State of Florida issued Executive Order 17-235, declaring a state of emergency to include Polk County, Florida;

WHEREAS, the Executive Order, in accordance with Chapter 252, Fla. Stat., authorizes political subdivisions to take whatever prudent actions is necessary to ensure the health, safety, and welfare of the  community; and

WHEREAS, Chapter 252, Florida Statutes authorizes political subdivisions to take all necessary action and issue any necessary orders to protect human life; and

WHEREAS, the chair of the Board of County Commissioners of Polk County, Florida issued Declaration of Local State of Emergency 17-01declaring state of local emergency, dated September 5, 2017; and

WHEREAS, Polk County Ordinance 05-041, Section (7)(3) authorizes the County Manager to establish curfews; and

WHEREAS, it is necessary to keep law enforcement personnel available during this emergency without the distraction of  having to  monitor  non-emergency  and unauthorized traffic or movement; and

WHEREAS, the Polk County Emergency Management Director and Sheriff have recommended the imposition of a 12:00 a.m. to 5:00 a.m. the same day curfew within the geographic boundaries of Polk County, Florida in  order  to ensure the  protection of life and property; and

WHEREAS, a curfew is necessary to ensure the healt h, safety, and welfare of all individuals within Polk County; and

WHEREAS, a violation of a duly promulgated order is an second degree misdemeanor punishable by a fine of up to $500.00 for each offense and by a term of 252.50, Fla. Stat.

NOW THEREFORE, it is hereby declared and ordered: 

Pursuant to the authority of Polk County Ordinance 05-041, the County Manager hereby establishes between the hours of 12:00 a.m. and 5:00 a.m. the same day a curfew in Polk County, Florida to include both the incorporated and unincorporated areas of Polk County, Florida. The following shall be exempt from this Order: 

  1. essential services, such as fire, police, emergency medical services, hospital services, including services for the transportation of patients, utility emergency repairs, and emergency calls by physicians and other appropriate emergency relief actives;
  2. county and municipal emergency management personnel;
  3. on-duty military personnel; 
  4. media personnel;
  5. persons traveling to and from
  6. any m unicipality may opt out of this curfew at their discretion

This curfew shall take effect at 12:00 a.m., 11th day of September, 2017 and remain effective until repealed by subsequent order of the County Manager or his designee.
