PROPOSED RESOLUTION NO. 25-044

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LAKELAND, FLORIDA RELATING TO PUBLIC RIGHT-OF-WAY; MAKING FINDINGS; DECLARING THE CITY COMMISSION’S INTENTION TO ADOPT AN ORDINANCE VACATING A PORTION OF A PUBLIC ALLEYWAY LOCATED EAST OF S. FLORIDA AVENUE, SOUTH OF E. MAIN STREET, WEST OF S. TENNESSEE AVENUE AND NORTH OF E. LEMON STREET, SUBJECT TO THE RESERVATION OF A PUBLIC UTILITY EASEMENT; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE.

WHEREAS, the City of Lakeland has received a request from the property owner of 113 S. Tennessee Avenue to vacate the north 81 feet of a public alleyway located east of S. Florida Avenue, south of E. Main Street, west of S. Tennessee Avenue and north of E. Lemon Street within the City of Lakeland, Florida; and

WHEREAS, the City Commission of the City of Lakeland finds that it will further the public health, safety and welfare for the above-described public right-of-way to be vacated, subject to the reservation of a public utility easement over the entire area to be vacated;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LAKELAND, FLORIDA:

SECTION 1.  The City Commission hereby declares its intention to adopt an ordinance discontinuing, closing, vacating and canceling the north 81 feet of an existing public alleyway located east of S. Florida Avenue, south of E. Main Street, west of S. Tennessee Avenue and north of E. Lemon Street, as more specifically described and graphically shown on Exhibit “A,” attached hereto and incorporated herein by reference, subject to the reservation of a public utility easement over the entire area to be vacated, and provided further that the property owner pays a vacation fee to the City in the amount of $17,994.89.

SECTION 2.  Owners of real property abutting the right-of-way intended to be vacated have been notified of this intention and any persons having any objections to the vacation of this right-of-way may be heard during the meeting of the City Commission of the City of Lakeland beginning at 9:00 a.m. on the 18th day of August 2025, at Lakeland City Hall, City Commission Room, 228 S. Massachusetts Avenue, Lakeland, Florida, when the ordinance vacating the right-of-way will be considered.

SECTION 3. This Resolution shall take effect immediately upon its passage.
