A RESOLUTION RELATING TO PUBLIC RIGHT-OF-WAY; MAKING FINDINGS; DECLARING THE CITY COMMISSION’S INTENTION TO ADOPT AN ORDINANCE VACATING PUBLIC RIGHT-OF-WAY LOCATED SOUTH OF WALNUT STREET, WEST OF S. WEBSTER AVENUE, NORTH OF HERSCHELL STREET AND EAST OF CORNELIA AVENUE; REPEALING RESOLUTION 4967; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Lakeland has received a request from the property owner to vacate certain public right-of-way located south of Walnut Street, west of S. Webster Avenue, north of Herschell Street and east of Cornelia Avenue within the City of Lakeland, Florida; and
WHEREAS, the City Commission of the City of Lakeland finds that it will further the public health, safety and welfare for said public right-of-way to be vacated;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LAKELAND, FLORIDA:
SECTION 1. The City Commission hereby declares its intention to adopt an ordinance discontinuing, closing, vacating and canceling existing public right-of-way located south of Walnut Street, west of S. Webster Avenue, north of Herschell Street and east of Cornelia Avenue, as more specifically described and graphically shown on Exhibit “A,” attached hereto and incorporated herein by reference.
SECTION 2. Owners of real property abutting the right-of-way intended to be vacated have been notified of this intention and any persons having any objections to the vacation of this right-of-way may be heard during the meeting of the City Commission of the City of Lakeland beginning at 9:00 a.m. on the 1st day of June 2026, at Lakeland City Hall, City Commission Room, 228 S. Massachusetts Avenue, Lakeland, Florida, when the ordinance vacating the right-of-way will be considered.
SECTION 3. Resolution 4967 is hereby repealed.
SECTION 4. This Resolution shall take effect immediately upon its passage.
